Hi, my name is Jenny and I am starting a cosmetics line but idk what i need ...my question is to start a business what is needed for her LLC to be in her name and do I need a seller's permit for selling online?I am starting my fragrance business. I am starting by selling perfume first but I intend to sale other non cosmetics products as well, such as jewelries, clothings. How do I register my business? Thank you for the help!

Business Licenses and Registrations

  • General Business License

  • Home Occupation Permit

  • Seller's Permit or Sales Tax License

  • Employer Identification Number (EIN)

  • Industry-Specific Requirements

  • Cosmetic Product Registration

  • Import License

  • FDA Registration (for certain cosmetic products)

  • Online Business Considerations

  • Domain Name Registration

  • Business Name Registration (DBA if applicable)

  • Relevant e-commerce platform registrations

  • A: Hi Jenny, yes, to sell online and in person, you need the seller's permit and we can help you obtain it here online.

There are three steps to starting a business:

First, you need to select a business structure.

Second, you need to obtain licensing.

Third, you need to register for taxes.

Even though you will need the LLC to buy the cosmetics items wholesale, the first step involves the assumed business name "Cosmos Cosmetics Llc," which is a fictitious business name and is required to be registered with a DBA, LLC or Corporation.  When you select the structure, you select a DBA if a sole proprietor, and a corporate certificate if an LLC or corporation.

The second step involves a business license that is required for all businesses.

The third step involves employment and sales tax.

For sales tax, you will need a
seller's permit.   For instance, if Jenny buys 10   Cosmetics items for $1.00 each, she would have to pay $10 plus sales tax but since she buys wholesale she buys tax free so she pays only $10 instead of assuming the state tax is about 7% tax, $10.70.

For employment tax, if Marvel is an employer, she will have to obtain 2 more tax IDs: a federal EIN and a State Employment Tax ID Number (SEIN). I need both licenses then? business and seller's permit? I'm planning to sell variety products, such as cosmetics, accessories, etc.different products, such as Maybeline, Lorea'l, Este Lauder, etc,

Skin Care and Cosmetics Industry Overview

The beauty and personal care market in the United States is thriving, with projected revenue of $92.94 billion in 2024. Online sales are particularly robust, accounting for an increasing share of total sales each year. As you embark on your skincare and cosmetics venture, you're tapping into a growing industry with significant potential.

    Initial Investment and Equipment

Starting a home-based online skincare and cosmetics business can be relatively cost-effective compared to brick-and-mortar operations. Your initial investment might range from $5,000 to $20,000, depending on your inventory, website development, and marketing strategies. Essential equipment includes:
  • Computer and high-speed internet connection

  • Quality camera for product photography

  • Packaging and shipping materials

  • Storage shelves or units for inventory

  • Business Structure and Registration

Choosing the right business structure is crucial. An LLC (Limited Liability Company) offers personal asset protection and tax flexibility. An S Corporation can provide tax benefits for some business owners. Each structure has its pros and cons, so consider your specific needs and growth plans. Registering your business name is typically required, whether you form an LLC, S Corp, or operate as a sole proprietorship. This process, often called "doing business as" (DBA) registration, allows you to operate under a name different from your legal name.

EIN: Your Business's Social Security Number

An EIN (Employer Identification Number) is essentially a social security number for your business. It's used for:
  • Opening business bank accounts

  • Filing tax returns

  • Hiring employees

  • Establishing business credit
  • Even if you're a sole proprietor without employees, having an EIN can help keep your personal and business finances separate.

    Seller's Permit and Sales Tax

As an online retailer selling to all 50 states, you'll likely need a seller's permit. This permit allows you to collect sales tax from your customers. With the rise of e-commerce, many states have enacted economic nexus laws, requiring out-of-state sellers to collect and remit sales tax once they reach certain thresholds of sales or transactions in that state.

    Additional Licenses and Permits

The cosmetics industry is regulated to ensure product safety. You may need:
  • A general business license

  • Home occupation permit (for operating from your residence)

  • Specific permits related to manufacturing or selling cosmetics
  • Some products may require FDA approval or registration, especially if they make certain claims or contain specific ingredients.

    Final Thoughts

Starting a skincare and cosmetics business from home can be an exciting venture. With the right preparation and compliance measures in place, you'll be well-positioned to capitalize on the growing demand for beauty products online. As you navigate the regulatory landscape, keep in mind that requirements can change, and staying informed is key to your business's success and longevity.

Answer: Hi John, you do need a seller's permit in Louisville Jefferson County Metro Government, because you sell Cosmetics , you will need the seller's permit to buy the  items   wholesale. You also need the sales number(seller's permit) to sell them because you need to collect sales tax at least for the instate sales. Other than that, you will need to register the trade name "B & Shayycosmeticss," with a DBA, LLC or corporation.

If you hire anyone, as for example, to sell the Cosmetics , you will also need a state EIN in addition to the federal EIN.  The estimated cost of licensing is $199 if you purchase all you need.

    Market Overview & Startup Investment

The e-commerce resale market is booming, with projections showing a $47 billion market size by 2025. Your diverse product mix positions you well in this growing space! For a dropshipping-style online resale business, initial capital needs are relatively modest:
  • Website/E-commerce Platform: $500-2000

  • Initial Product Photography Equipment: $300-800

  • Basic Office Supplies & Packaging Materials: $200-500

  • Business Formation & Permits: $500-1000

  • Business Structure Basics

An LLC often makes sense for e-commerce businesses due to personal asset protection and tax flexibility. S-corps can offer tax advantages once revenue reaches higher levels through salary/distribution optimization.

    Essential Business Components

The Employer Identification Number (EIN) functions as your business's social security number - it's needed for:
  • Opening business bank accounts

  • Filing business taxes

  • Working with suppliers

  • Hiring employees (if you expand later)

  • Sales Tax Considerations

A seller's permit allows you to collect and remit sales tax. For online sales:
  • You'll need to track tax rates for different jurisdictions

  • Keep meticulous records of sales tax collected

  • Dropshipping Specific Requirements

Since you're utilizing a fulfillment partner:
  • Resale certificate needed for tax-free inventory purchases

  • Clear agreements with storage/fulfillment partners

  • Record Keeping Essentials

    Set up systems for tracking:
  • Sales records

  • Inventory movement

  • Customer data (privacy compliance)

  • Expense receipts

  • Tax documents
  • Would you like me to expand on any of these areas or provide more specific information about any particular aspect?

    Industry Snapshot

The beauty and personal care industry is booming! It’s projected to be worth around $580 billion by 2027, with online sales representing a major slice of that pie. And that’s not just fancy face creams—beauty tools, fashion accessories, and general lifestyle products are riding this wave too. Your business, a “resell shop” offering beauty tools, clothing, toys, and more online, is perfectly positioned to tap into this demand without the headache of inventory storage thanks to your fulfillment partner.

    Capital Needed to Get Rolling

Starting an online resale shop generally requires a moderate initial investment. Here’s a quick breakdown of where some of that initial capital might go:

    • Business registration and LLC formation: Depending on your choice of business structure, you’ll need some cash for LLC filing fees. LLCs are a popular choice because they offer liability protection, which means your personal assets are safer if your business faces legal issues.
    •
    • Seller's Permit: For reselling products, especially across multiple categories like beauty tools, clothing, and toys, you’ll need a seller's permit. This permit allows you to buy inventory without paying sales tax, as long as it’s for resale. But, when you sell to customers, you'll charge sales tax on taxable items (based on your state’s tax laws). This keeps the tax folks happy.
    •
    • Website and e-commerce platform: You’ll likely want to spend a bit on a user-friendly platform like Shopify or WooCommerce. The upfront costs can vary, but it’s worth getting a platform that can handle multiple product types and integrate with your third-party fulfillment provider.
    •
    • Marketing and branding: Budget for advertising, especially social media and Google ads. It’s the digital age, so you’ve gotta catch those clicks. You’ll also need to set aside funds for product photography and design work for a professional look.

Setting Up an LLC (Limited Liability Company)

Forming an LLC is a smart choice for many small business owners, especially those selling online. Here’s why:

    • Liability Protection: An LLC helps protect your personal assets. If your business faces a lawsuit or runs into debt trouble, your personal stuff (like your car and home) is typically shielded.
    •
    • Professionalism and Credibility: Customers and suppliers may take your business more seriously if it’s an LLC rather than a sole proprietorship. It also makes it easier to open a business bank account.
    •
    • Flexible Tax Options: With an LLC, you can choose to be taxed as a sole proprietor, partnership, or even an S Corporation (which can have tax advantages once your business income grows).
So yes, for the type of business you’re running, an LLC is a popular and practical option. It’s fairly straightforward to set up, and it can save you headaches down the road.

Seller's Permit: Why You Need It

For an online resell shop, a seller’s permit is crucial. Here’s how it works:

    • Tax-Free Purchasing for Resale: With a seller’s permit, you can buy products from wholesalers without paying sales tax. Since you’re not the final consumer, this lets you save money on your inventory costs.
    •
    • Sales Tax Collection: Most states require you to collect sales tax on goods you sell to customers. A seller’s permit allows you to legally collect and remit this tax. Think of it as being a tax collection agent on behalf of the state.
    •
    • Avoiding Penalties: Selling without a seller’s permit (when required) can lead to fines or penalties. It’s better to be compliant from the get-go than risk any surprises.

Do You Need an EIN (Employer Identification Number)?

An EIN is like a Social Security number for your business. Here’s why it’s helpful:

    • Opening a Business Bank Account: Most banks require an EIN to open a business account. This keeps your business finances separate from personal ones—an essential step for bookkeeping and tax reporting.
    •
    • Hiring Employees: If you ever hire employees, an EIN is mandatory for payroll purposes.
    •
    • Filing Business Taxes: Even if you’re not hiring employees right away, an EIN is needed if your LLC elects a tax status other than sole proprietorship, or if you’re required to file excise taxes.

    Additional Permits or Registrations

Depending on your state, you might need a General Business License to operate legally. This is a basic license required by some local jurisdictions, regardless of the business type. And since you’re in the beauty sector, check if there are any special certifications needed for beauty tools (some states have strict rules about health and hygiene products). But generally, if you’re reselling items like beauty tools and clothing, a seller’s permit and business license will cover most requirements.

    Key Takeaways

To sum it up, here’s your checklist to get your beauty tool and resale shop up and running:

    • Form an LLC: For liability protection and credibility.
    •
    • Get a Seller’s Permit: To buy inventory tax-free and legally collect sales tax.
    •
    • Apply for an EIN: If you’re forming an LLC or plan to hire employees.
    •
    • General Business License (if required): Check if your state or locality requires one for online retail.

    Business Operation Licenses

A home-based business requires a general business license, sales tax permit/seller's permit, and a doing business as (DBA) registration if operating under a name different from your legal name. For selling beauty tools, you'll need product resale certification.

    Home-Based Business Requirements

Operating from a residential location necessitates home occupation permits and zoning compliance verification. Since you're storing inventory and crafting items, you'll need residential business operation approval and possible home safety certification.

    Industry-Specific Requirements

  • Beauty tool reseller certification

  • Merchant resale number

  • Craft manufacturer registration

  • Fishing equipment vendor permit

  • Tax and Business Structure

Register your business structure (sole proprietorship, LLC, etc.), obtain an Employer Identification Number, and establish proper sales tax collection methods for both online and local transactions.

You can choose to be a(n) Beauty Tools :

    • Sole Proprietor,
    • LLC,
    • Corporation or
    • Partnership.
After you decide and select your business entity, you need licensing.

Los Angeles Business Tax Registration ( Business License)
All businesses including home, online or mobile BUSINESS need a BUSINESS license because they are BUSINESSES.

A(n) Beauty Tools business using a fictitious business name in Los Angeles County i.e. you are a business with a trade name other than the owner's legal (full name) name are required to get a(n) fictitious business name.   For instance you open a(n) Beauty Tools business and you name it "Superior Beauty Tools Group". You will need to file a fictitious business name for that name.

In addition note that in CA you may also need a seller's permit if you sell merchandise that is taxable.  (A.K.A state id, wholesale, resale, reseller certificate, about $39 for most states).
    Seller's Permit

Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.
However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting a federal tax ID number.

In addition you will need a federal and a state EIN if you will hire employees. I.e., a CA Federal Tax Id Number ($29)  and a(n) CA  State Employer Tax Number

Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Los Angeles, Incorporate in CA  or form a(n) CA LLC
    .

You have a choice to file a DBA or form an LLC or incorporate. There is a cicrcumstance that you may not need to register a trade name and that is when you use your full name as a business name if you use your full legal name as a trade name.
Also note that even using your first and last name may not help you avoid filing a DBA if the name has a suffix such as "& sons" etc.

If you do form an Online Store llc or incorporate (about $49 plus state fees for most states) your Beauty Tools business instead of just filing a fictitious business name (dba), it will help you avoid personal liability from wrongs arising from your business dealings and you will not have to file the Los Angeles business name. Instead of just registering your Los Angeles County assumed business name (our fee includes assumed business name registration and legal newspaper publication) you can choose to setup a corporation in CA or form an CA LLC (starts @ $49 plus state fee for most states & includes required documents such as bylaws for the corporation and Limited Liability operating agreement for the LLC). .
